Dishonest Administrator

I am one of seven siblings who are named to share equally in our deseased parents estate. Four of us, including the administrator of the estate, wants to give the property to the administrator. I and two others object. How best can we protect our interest in the estate.

If you are a beneficiary you are entitled to receive the portion of the estate that the decedent left to you.

If you are concerned about the honesty of the administrator you should investigate and obtain information about whether the administrator is acting appropriately. If he/she is not acting appropriately, steps should be taken to have him/her removed from that position. This is something that, should funds be available, you should hire an attorney to do on your behalf.

With respect to giving your share to the administrator, California law provides for compensating the administrator.

If you are entitled to part of the estate it is yours. If your siblings want to give their portion of the estate to someone else they can.

What you need to do is examine everything the administrator does and make sure no funny business happens with the assets of the estate. Make sure the initial inventory is correct, make sure the fees for the administrator are in line with the norm, make sure the death taxes are paid, etc. You may want to consider hiring an attorney to represent you as a beneficiary to the estate.
