Who is entitled to family home

My ex husband died suddenly, we have been living together on and off for the past 8 years, I was solely responsible for all of his burial arrangements. We have 2 adult children and 1 minor child (his name was not placed on this child's birth certificate beacuse I feared that he might take my child and leave the state.)He loved, accepted and supported this child. When we was marriage we purchased our home together, shortly after our divorce I was looking to purchase a home of my owe I legally removed my name from our home. Can I regain ownership of this property. He left no will. Can you also direct me as to how I can prove that my ex husband is the legal father of my minor child, so that his name can be rightfully added on my child's birth certificate.

I was young and foolish, and would desperatly like to correct my mistakes. My adult children are in full agreement with all of my plans.

Has an estate been opened. I assume he did not remarry. If your children were his only children they would be the beneficiaries under the intestate succession. One of your adult children or even you could file for letter of administration to probate the estate. Provisions could be made by way of an agreement that your youngest child could share in the proceeds. In any event you should contact an attorney immediately to help you with the estate as there would be taxes due not to mention possible bills and expenses of the estate.
