Estate problem

my mother

has just passed away and i am excecutor, my stepfather automatically gets the house and land that they live in, right? Am I entitled to the house and land since I helped build it and stayed there for 15 years. My address was there. Also if he passes away. What are my legal rights? My father has one sister and brother. My stepfather also has two daughters. What are my rights under PA law?

Re: Estate problem

Condolences on your loss.

The following apply only if your mother resided in PA at the time of her death:

Ownership of the house and land and other property depends on how they were owned by your mother. If the property is part of her estate, and there was a will, the will controls. If there was no will, her property would pass under the PA Intestate Succession law, which sets the order in which heirs are entitled to inherit.

You should consult an estates lawyer in the County where she resided to help you determine what your rights are.

This response is not legal advice, since I do not have all of the information that would be required, and I do not have a representation agreement with you.

* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.

* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
