Executrix

Sister is executrix of deceased father and grandfathers will, the estate started out with a sizable amount, me being the beneficiary, when time to distribute estate, it was greatly reduced, there was a car purchased which my sister says was for granfathers use. (bought a year before his death). I disagree with some of the receipts what should I do.

There are two ways that your sister can settle the estate. One is through a family settlment agreement attached to the settlement agreement should be a summary accounting showing the assets of the the estate minus the debts and expenses of the estate and what is left for distribution. It should also have a schedule of distribution attached, showing how much is to be distributed to each of the beneficiaries. IF all of that information is satisfactory to you, you can sign the family settlement agreement.

If the family settlement agreement is not satisfactory to you, or if the executrix does not produce a family settlement agreement in a timely manner, you can force her to file an account with the court. This is done by Petition to the Court. The court will then set a date, for which the account will be brought to audit any problems with the account should be made to the court prior to the audit.
