Fair Distribution of Father's Estate

Our father died leaving no will. My youngest sister was living in his house. My other siblings signed, relinquishing their rights to the home. I didn't and requested my name along with her's be placed on the title. She now claims she won't, and that I can't do anything, and if I do she will bring me back many times to court..living in Calif, that is a problem. I then asked if she doesn't want to share the property with me, then she should buy me out. I requested 20%, since there is 5 of us, I felt this is fair. What are my rights, and what should I do? Thank you

Hire a lawyer in CA to file a probate. you are entitled to 1/2 the house and the probate can force a sale of the house. this is very simple. If you are in So. CA I can help you.

If your sister doesn't want to cooperate. Then you need to file a petition for probate in the state and county in which your father's property is. You and I thinking your sister is fair or unfair isn't going to cut it. We'll be doing this 50 years from now. So hire an attorney and file the petition. Your sister's threats of bringing you back to court numerous times is pure bull shit. Filing the petition is probably going to be the only way your sister is ever going to get the property in her name. So she'll eventually have to do it. So you do it for her, and the sooner the better.
