Father's Estate

My fathers estate went into probate in 2002. There was an executor issued to the estate by me(son of deceased). I reside in another state from the deceased. I have not heard anything up till the present about the progress of the estate from the appointed attorney. It has been 5 years since my fathers passing. and I have not heard a thing from anyone. This is troubling me immensly. There are a lot of circumstances involved in this matter that I feel have gone wrong. I would like to know who I could get a hold of to see what exactly is happening. There are things that should have been taken care of 6-9 months after his passing. Nothing that I have looked into have been done. I have been on the internet and on the phone. I really feel that the executor that was appointed is not doing his tasks and neither is the attorney assigned to the estate. What can I do to rectify this whole mess? The way that I see things happening really troubles me. Is there anything I can do to get the executor that I appointed off of the administration of the estate for not doing his job? Also have the lawyer removed from the estate and have one of my choosing appointed? If you could assist me in this matter it would greatly be appreciated.

While estates do take time to probate 5 years is a bit much. Especially since if certain tax forms are timely you get a discount on the taxes due.

As to find out where the process of probate stands you need to contact the Register of Wills in the county where your father died. They can at least give you an idea what if anything has been completed.

This is not the first case like this I have heard of.

Your facts are a little unclear. Was there an executor appointed in the Will. You said you hired the executor and I presume the attorney. Are their other beneficiaries? Certainly you can contact the Register of Wills in the county where the will was probated to find out if anything has been filed. Inheritance taxes were due nine monthes after death. Were taxes paid. If neither the executor or Attorney responds to you , you can file petitions to remove the executor and or compel an accounting of the Estate. You should consult with an attorney.
