Legal Question in Wills and Trusts in Pennsylvania

I was given a gift from Dad 20 years ago that pissed off my sister. She nudged him for years, so he told her he only loaned it to me to get her to stop bothering me. She is the executor of the will. First thing she did when he died was to come after me for this gift and she told me she will sell it. My Dad never wanted it sold. He also gave it to us. One lawyer told us it would probably cost over $10,000 to protect our rights. The item is worth $50,000. My Sister got gifts worth more than $50,000, but to her those our gifts, since we have this item, it is not a gift. If we hire a lawyer, can we get our legal fees back from our Sister for being frivolous? The Estate Lawyer sent us a letter ordering us to return the item saying it was not a Completed gift.

There are no guarantees, but it sounds to me like you have a legitimate issue. Have you consulted a lawyer yet? If you would like to discuss this in some more detail, feel free to call me direct at 215 592 0033 or write back. I've handled complex matters like this since 1991.
