If you have taken the will to the Register of Wills for probate and your husband is the executor as you stated, this is not a difficult question. A final tax return (and any other unfiled returns) must be filed for the decedent. The decedent's estate should receive the refund. After all of the probate procedures have been followed and expenses paid, your husband should receive what is left from the estate. Your husband needs to see a probate attorney and must first probate an estate. If there are back tax returns which must be filed, your husband may need to see a CPA. If you are talking about tax years prior to 2011, then your husband will definitely need to see a CPA. If its just for 2011 taxes, then a final return will be filed and any refund will be paid to the friend's estate and then disbursed as per the estate once all the bills are paid.
