Inheritance not taken

My brother has not yet taken his inheritance after 3.5 years. He has caused the estate to remain open. We have repeatedly asked him to do so. We can't ask him to sign a denial because he won't sign the paper to get his money. He delights in being difficult and obstinate. Can the money be re-distributed to the other heirs or will it revert to the state as I have been told? Can you cite a case that shows it can go to the other heirs if one exists?

I think the term is Disclaimer but I maybe wrong on that. In any case this a job for the estate's attorney to deal with.
