Legal Question in Wills and Trusts in Pennsylvania
inheritance / divorce
I am in the process of a divorce and have been separated for about 10 months. My husband and I moved into a house purchased by my father some years ago when he took out a note on his own home.My husband and I intended to purchase the house when we were better able to get a loan and when my husband solved his tax issues. There was never a written agreement of any kind. Monthly payments were made to my father. Several years later we were still unable to purchase the house. I still live in the house and rent it from my father. My father has never paid any upkeep or maintenance. He is now ill and wants to leave me the house as my inheritance. Our concern is, since the divorce is not final, would my husband have claim to my inheritance?

Re: inheritance / divorce
In PA inheritance is generally not considered marital property as long as it is not put in joint names.
Good luck to you.
