Inheriting Real Property

When my wife's mother died, she left my wife a piece of property. This property had back taxes owed on it at the time of her death that are more than what the property is worth. Are these back taxes passed on to my wife as her responsibility along with the property or are they eliminated upon the death of her mother? There was very little money in the estate and it was all used for the burial. At this point there is no money left from the estate. What are our options?

I agree with Mr. Johns, another option is then purchase back the property at the Sheriff's sale, or just pay the back taxes if you don't want the headache and the complications of a foreclosure process. It all comes down to want you want with this property? But if you do accept the bequest you are responsible for the taxes.

If you are sure that the property has more in back taxes than it is worth than if she has not yet had it deeded over to her she can refuse the bequest. Eventually, the state will sell it at sherriff's sale.
