Joint Tenancy with right of survivorship
Hello,
My mother is dying and has not made arrangements for her house. How do I make a JTROS legal. Can I get the form at the county courthouse? Yes I am trying to lessen the probate & taxes! My sister and I paid the taxes to get my mother in the house after my father died. (They were divorced) I just do not want to pay the taxes again, my mother's death is eminent. Any suggestions?

You must change the title. But but you may not be
able to "avoid" the State estate tax because the
transfer was in contemplation of death or too close in time to the death. To change a title you
must file a deed that is propertly executed by
the grantor. (your mom) See a lawyer for this, it
is not particularly expensive and will be done
correctly the first time.
