Next of kin

My uncle died with no wife or children. Brothers sisters dead. I am his blood nephew. Does this make me next of kin ?

Maybe, did your uncle have a will?

You didn't mention if your uncle had surviving parents. If not then you maybe the closest heir at law.

John is correct, that if there is no Will, the intestacy statutes control the disposition of the estate and who can qualify to administer it. Presuming no parents are surviving, there are no spouse, children or grandchildren, the next in line are brothers and sisters, if any. If no brothers or sisters, nieces and nephews are next. If you are the only child of the brothers and sisters, you are the only next of kin. However, if you have first cousins, they are equal with you and all are entitled to a share of the estate and all are entitled to be appointed as Administrators of the estate.
