I am not sure what this has to do with probate, wills, trusts and estates, but Iyou need to obtain the owners of the gravesite or relatives of the deceased who is buried there (especially if you are opening the grave) and possibly the approval of the cemetary as well as they may actually have to open the grave.
You will have to be responsible for any costs of opening the plot and adding a gravemarker/headstone. There might be pollution or other regulations so you should not just sprinkle the ashes on the grave.

I don't know why you couldn't. The people to ask are the people who run the grave site.
