Can a family member sue for life insurance if they are not listed on the policy...if the person is a child of the deceased and the child lives in another state

In general, the person who is insured can name anyone they want. If it were a wife left off the policy, you would agree that no suit could be filed. Logically the samed is true for life insurance; if the person taking out the insurance lists all of his possible heirs and why they are getting nothing, the case becomes even stronger.

Yes a family member can sue to set aside or reform the decedent's life insurance policy for any number of reasons, including, for example, a claim that the beneficiary designation was procured by undue influence.
