My Father - In - Law recently passed away. My husband is in charge of the estate. He left no will. He lived with a girlfriend for 5 yrs. He was divorced 10 years ago to his 2nd wife. The life ins. co. states the money is going to the ex -wife from 10 years ago although she is remarried and got a $15,000 settlement. According to his job, since he was married to her when he retired, the beneficiary cannot be changed no matter what. We have never heard of this! The insurance is worth @ $20 - 40,000. She refuses to pay for the funeral. Are we stuck with this bill now? We know this money was to pay for his funeral! Incidently, there is @ a 50,000 loan of money missing that he received, that we cannot find. He has nothing. We can find no money, his bank accounts are 0. He filed for Bankruptcy 2 months before he died. Also, he was on a car with the girlfriend - she took the car. We hired a lawyer who states there is nothing we can do. I can't believe there is no justice in our system! We have a $10,000 bill to pay. I don't have that kind of money laying around!The insurance company states that she cannot get the money without a death certificate/official executor of the estate notice - which my husband won't give her.Can we do anything?

Well you do have some bargaining power with the ex-wife.

Other than that it appears who gave him the loan is out of luck as the estate is insolvent.

As to the car that's tricky because if it was on his bankruptcy than the girlfriend may have problems with it. It depends on what you mean by " he was on a car with the girlfriend" on the title or the note or both?
