Re: living trust -rights of widow

It depends on what was provided in the living trust, which became unchangeable upon death of the person who created it, and also upon whether it was created before or after the marriage and if it was disclosed to the wife.

You should consult an estates lawyer in your area for more advice, and be sure to bring along a copy of the entire trust document.

With respect to the deceased's estate that is not in the Trust, if there was a Will, it should provide for the widow, and if it did not, the widow has a right to make a claim against the estate for a portion of the estate.
