Legal Question in Wills and Trusts in Pennsylvania
My mother passed away in February, 2012. my eldest sister and her husband, who is an attorney, took control of everything. There are seven csurviving children. a large trailer park in which we are suppose to be getting money each month and she is not dispersing any of this. What are we to do? I have texted her numerous times to give us our proceeds and she does not respond.

Get your own lawyer. Its been over 4 years. Most estate administrations are completed within 1-2 years. So your first order of business needs to go to the county where your mother resided at the time of her death and see if an estate file was opened. If so, make a copy of all documents in the file. Most important ones will be a will, inventory of assets and an annual or final accounting. If the estate is still open, then why? The register of wills/probate court sends out letters if accountings are not filed and they will want to know why the estate is still open. If there is no will at all (highly unusual), then is there a trust? If so, most trusts require beneficiaries to be notified and to receive annual accountings from the trust. If nothing has been done and there is no estate file, then the attorney can inquire of your sister as to where things stand. Then you will at least have an idea. If they will not cooperate then you will have to file a petition to have sister removed as the personal representative or trustee.
