Legal Question in Wills and Trusts in Pennsylvania
Should I pay mortgage on deceased fathers house until the estate can be settled
1 Answer from Attorneys
If you do not pay the mortgage then the house is foreclosed on. Your call.
If you are the beneficiary, why cannot the home be distributed to you immediately if there are other assets in the estate sufficient to pay any claims? If you are the personal representative, then you need to speak with a probate attorney who practices in the county/state where the home is pending.
Generally, beneficiaries of an estate inherit property subject to mortgages and are utlimately responsible. The executor of course needs to appraise the property and possibly sell the property if equity is needed to pay other claims against the estate. So what you do will depend on the circumstances.
