Legal Question in Wills and Trusts in Pennsylvania

Power of Attorney acting in his own interests

My uncle has a severe case of Cerebral Palsy, and he is 72 years old. He recently inherited a large amount of money. A distant cousin is now in the picture, he is also in his 70's, obviously he is nosing around for the money. My uncle has been influenced ''Tricked'' to assign the cousin as Power of Attorney because my uncle seems to trust him. I believe the P.O.A. will try his hardest to convince my uncle not to include my sisters and I in the will, because the cousin would rather his family receive the inheritance. Is there anything I can do?

Re: Power of Attorney acting in his own interests

This is a pretty complex issue. One is there a current will and do you have a copy. Two your uncle needs to be of sound mind and body when making a new will. If he creates while he is ill and you can prove through medical records that the will was done with undue influence etc than you have a strong position to contest the will. In some states if the will in thrown out that the estate to the heirs that may help you.

If you would like to discuss this further please call my office for a no obligation free intiial consultation.
