Legal Question in Wills and Trusts in Pennsylvania

power of attorney and last will and testament

my father is taking my older sister off as power of attorney and on the last will and testament. The attorney, who is friends with my sister, changed the power of attorney to my name, but left my sister on the last will and testament. My father, as I write this is around there upset, he wants her off completed in every level of power. Why did the attorney keep her on the last will and testament?

Re: power of attorney and last will and testament

I am not sure I understand your question as written. It appears your father does not want your sister to be his power of attorney. When you say and on the Last Will and Testament I am somewhat unclear. Does he not want her to have any administrative power over his estate when he dies then he should not name her as an executor. Does he also want to disinherit her so she is not a beneficiary under his will? Perhaps the will names someone other then your sister as executor but still names her and others as beneficiaries. If your father wants your sister to neither be a beneficiary and or executor then the will should be channged. I suggest your father make an appointment with a lawyer perhaps different then your sister's friend to review the present documents and see what he wants. I would be happy to meet with him if he wants to set up an appointment.
