Legal Question in Wills and Trusts in Pennsylvania
probate.
My mother died april 7,2007. She left everything to my father. does her will need to be filed or probated?we have done nothing because we assumed nothing needed done since she left everything to my father.

I agree with the previous response. Unless there is some reason to raise an estate ie to bring a legal action on behalf of the Estate or to cash monies made payable to the estate there would sem no reason to probate the will. If property real estate was located in another state then a probate might be necesaary in that state.
Re: probate.
It isn't necessary unless something like stocks or accounts were in your father's name alone and the value exceeds 25K. If he left an automobile titled in his sole name the title can be transferred without probating the will. All jointly owned assets passed by operation of law to your mom. There would be no inheritance tax due.
