Dear Sir/Madam:
The simple answer to your question is yes, typically you have to probate a Decedent's Will in the County in which the he/she resided at the time of his/her death. However, let's assume that you are the Executor and that you live in another county then the Decedent or even in another state altogether. What can be done for purposes of convenience, is that the necessary paperwork can be prepared and delivered to the Register's Office in the County where the Decedent resided and you can request that the Register then forward same to the county or state in which you reside. You can be sworn in as the Executor by your local Register's Office and they will then forward the paperwork back to the county in which the Decedent resided. The remaining probate procedures and filings can also be handled by mail. This probably sounds fairly simple, but the process can be more complicated than it appears. Typically, it is a wise idea to seek out the advice of a competent estate attorney.
