Re: probate a will
Dear Sir/Madam:
You can present a petition to the Register of Wills Office in the County where the Decedent resided seeking to have the "copy" of the Will admitted to probate. While you might attempt to do this on your own, it is generally advisable to retain an attorney to pursue such a course of action.
The problem you may encounter is if there are other parties to this matter who would be opposed to your petition. Namely, you would have the burden of demonstrating that the Decedent did not, in fact, destroy his original document. As I stated, if other people are going to oppose your attempt to probate the copy, you may have a difficult time overcoming the burden that the original was not destroyed.
In any event, if you would like to discuss this matter with me further, please feel free to contact me directly either through our website at www.americanwillsandestates.com or by email at [email protected]. Thank you.
