That depends on how the property is titled. If the property is titled as joint with rights of survivorship, then should one owner die, the other owner takes title to the property.

Since Pennsylvania does not recognize same sex marriages, it is very important that the parties have Wills drawn up to express how they want their estates to pass. The intestacy laws, which govern how property passes should someone die without a will, does not recognize same sex marriages. Therefore, the property may go to children, parents or siblings.
