Legal Question in Wills and Trusts in Pennsylvania

Property Ownership

My mother passed away and I found a will stating Real Estate owned by her is bequeathed to me. It further states in Trust for benefit of my handicaped Brother. It directs that said property be retained as a Life Estate for him. . Second part says property will be sold after his death and proceeds divided among her other sons. Who will own property to insure this happen?. Also will there be any State inheritance taxes as there are no Liquid assets. Can I appoint a trustee and give him the property. Lastly would appreciate any anfo you can provide and whether a Lawyer would be needed.

Are you the executor of the will. Does the will even appoint someone to be an executor.

This is a fairly complex will as it creates a trust.

As you are not in Pennsylvania you will probably need a lawyer to handle the filing of the will for probate and other matters.

If she died in Florida you are required to file the will with teh clerk of the court. If you are appointed the executor you are further required to hire an attorney to handle the estate. An estate is required by law to have an attorney because of the fiduciary issues. The executor of the estate has fiduciary duties not only to the beneficiaries but to any potential creditors as well.
