Removing Executor in PA

My father and I are beneficiaries of my grandmother�s estate, each receiving 50%. My father has been named as executor. He had a judgment against him from the IRS for not paying taxes and he refused to provide the court with records. He has had several judgments against him for his business when he also refused to provide the court with records that the judge ordered him to provide. A month before my grandmother passed away she named him as power of attorney, and the day after this was done he emptied out her retirement funds into an account that he was on. My father has refused to turn over paperwork and he has now fired the estate lawyer.

Last week when I questioned my father about the progress of things he told me that I was just a grandson, that it�s very unusual for someone to name a grandson in a will and that I would be lucky to get anything.

He has listed the house as him being the owner, not executor . I am worried that he has plans to get the money from the sale of the house and not distribute anything to me.

Is past behavior and threats or representing himself as the owner enough in the eyes of a court to remove him as executor? Basically � is there something I can do or do I just need to see what transpires? Thanks

You definitely have the right to act immediately if you feel that he has misappropriated funds both as the Executor and as her Power of Attorney. I would definitely suggest you hire legal counsel to assist you in this matter.

you do not indicate in which county your grandmother passed and where the will was probated. You certainly can bring an action to have your father removed as executor for not acting in the interest of all beneficiaries. You should contact an attorney immediately. I am in the Philadelphia five county area if the estate is nearby then you may contact at my office. If not find an attorney close to the Estate.
