Re: Renunciation of Administration letter

You have an existing executor or administrator and you wish to replace him.

If letters testimonial or letters of administration have been issued by Orphan's court, you will need more than a letter. You will have to petition the court.

If the estate is not in probate then when it is entered in to probate if there's a will there needs to be an affadavit from the executor named in the will where he declines the appointment.

If its an intestate matter (no will) then you need to apply to the court to be administrator.

Unfortunately, neither of these are do-it-yourself type motions. As there are other matters to be addressed such as whether a bond will be required, whether the administrator takes his fee or waives it.
