Legal Question in Wills and Trusts in Pennsylvania

sister is not abiding by my mothers will

Sister is Executor of mother's estate. My mom died Nov 8, 2004. My sister decided she wants to disburse the money obtained from the sale of my mothers will to people NOT in the will AND furthermore, she wants to give me less becuase she thinks I dont deserve it. That is, that I ''didnt do enough for my mom''. My mothers will dictates whatever is left from the sale of the house minus bills and my sisters EXECUTOR fees, will be divided evenly among the siblings(4 of us) HOWEVER, my sister has taken it upon herself to decide otherwise. Can she do this? Does this give her the power? What are my rights?

Re: sister is not abiding by my mothers will

Your sister is supposed to follow the directions of the will. Otherwise the beneficiaries may have a claim against her. They could also attempt to have her removed as executrix.

Simply put your sister cannot do what she wants, if she does, she can and would be held accountable by the Judicial and even possibly criminal justice system. I recommend contacting an Attorney ASAP.
