We had a will in NY State 30 years

ago but have since retired and

moved to our full time residence in

PA. and never redid the NY will. Is it

still in effect? We want like to have a

living trust in our home state of PA.

but also have a home in FL. that will

eventually become our permanent

residence. Would we have to redo

a PA. trust if we move to FL. Is a

trust valid regardless of where it was

originated and transferable to other

states.

Most states will recognize a trust as valid if it was valid in your home state when it was drafted.

I believe Fl will recognize a PA trust, however Fl is not a state I am admitted to practice in and this issue should be asked of your Fl attorney.

Yes your NY will is still as valid as when you drafted it. However does it still represent your wishes?

You will want to consider living wills and durable powers of attorney in your estate plan.
