Unexpected Death and No Will

My stepfather passed away with no will in April. Both my mother and I are concerned what happens now to his assets. Does everything go to mom or will she have to sell her home and divide the assets evenly amongst his children?

When someone dies without a will, the court has to administer distribution of the estate under the state statute. Usually, the next of kin is named hte administrator and beneficiary, so most everything would go to your mom. However, the court will take into consideration how much of his estate was community property with respect to the first marriage.
