Legal Question in Wills and Trusts in Pennsylvania
Waiting Time
I had a close friend that passed away the end of May 2002. I inherited his vehicle plus $10,000. Because he was in a nursing home that deleted most of his savings account after Medicare stopped paying, I had to wait for his house to be sold to receive the money. Settlement was made on the house the middle of September. Now I am informed it will be a couple more months because the lawyer has to file Inheritance taxes and money disbursement. Is this true? This information isn't coming from the lawyer's office; it's coming from his daughter. I am in need of this money ASAP; should I be trusting or pursue this further? Thank you.

Re: Waiting Time
Based on the facts it is typical to wait 1 year or longer for probate matters to settle. The executor of the estate must have enough funds to cover taxes and other matters before the remaining proceeds can be distributed. In some cases partial bequests can be administered, you may want to talk with the executor or the attorney to see if you could receive a partial amount now and the rest after the estate settles.
