Legal Question in Wills and Trusts in Pennsylvania

Will and estate

I believe that an elderly, now deceased realative was coned with her will. There are pages that are hand writen that give the execotors all of her personal effects, monies, safty deposit boxes with contents, furniture, family hielooms many of which have no monetary value. Do you think we have a case?

Re: Will and estate

Wills can be hand-written and executors can also be beneficiaries of the same estate. You would have to show that the decedent did not intend to have this particular executor inherit, either by being able to prove by other means that this person was not competent at the time of making the will or the decedent was unduly influenced.

Re: Will and estate

Unfortunately there are many cases where a person puts pressure on someone to make a will that cuts out other family members etc. The law allows you to contest the will in probate court but there is a limited amount of time to do this. If there us a substantial amount of property then it may be well worth your efforts to make this right.

I have handled a number of will contests over the past 33 years and will be happy to discuss this with you in some detail if you give me a call. No charge or obligation for the call.

Good Luck!
