Unfortunately, it is impossible for me to answer your questions without first reviewing the current Will that he has in place. Specifically, if he left everything to your late wife and he specified in his Will that the bequest to her was being made "per stirpes", then the gifts that were intended for her would pass down to her children. However, if the Will is silent in that regard, the gifts may pass to someone else who he may not have intended to inherit. Your father-in-law needs to have his Will reviewed to make sure that his intended estate plan is carried out. Your fatherinlaw must have the willreviewed to see what the effect of your wife's death has on his will. If it provided that i the event of her death it passes to her children then they would be the beneficiary. It may provide for other beneficiares. Finally it pay pass to your fatheinlaws heirs at law which may include his wife if he is still married to her or his son. In any event he should contact an attorney to review the documents and determine his intentions.
