If my husband and I both die simultaneously and have no will, I need to know if everything would go to my children even though neither child is my husbands biological child?

Depends if the state does not rewrite your will between today and the time you die.

You asked about simultaneous death, you should be aware it does not have to be as simultaneous as you think. If one of you die within 120 hours of the other then you are not presumed to have survive the spouse that died first.

That said for its a lot better to have your estates go where you want then relying on the legislature to do the job for you.

Bottom line: you both need wills.
