Maybe. If there is any part of the estate not mentioned in the will then the laws of intestacy apply. To avoid this this is generally a residual clause that cover any property not mentioned elsewhere in the will.

Also, if the spouse is not mentioned in the will, they have a right to an "elective share", however they have to specifically ask for it in writing six months after the decedent's death or before the expiration of six months after the date of probate, whichever is later.
