90 day temp comp
My employer is not accepting my claim. My comp insurance carrier keeps holding me back from getting an MRI. I think she's waiting for my 90 day temp comp to run out so they don't have to pay for the MRI. Nothing has been done from my comp insurance carrier since day one. Thats been over a month.They keep making excuses. I have worked for this company for 15years and I have good insurance coverage.My lower back is in so much pain that I can't sit down for a short time. I just want to find out what is wrong so i can get on with my life. Can I use my own insurance carrier to get an MRI and have them fight it out with my comp?

Yes you can and should. Don't be surprised if your health insurance carrier tries to avoid paying, though.

I'm a little confused. You state your employer is not accepting your claim, but then indicate they issued a Temp NCP, good for 90 days. I assume you're treating with the doc referred by the employer. It's actually very hard for the employer to comply with the law & force you to go to the company doc. It's very possible you may be able to treat with your own doctor & not have to treat for 90 days with the co doc. You need to consult with an experienced worker's comp attorney who will be able to guide you. Most attorneys who handle WC cases will not charge you for an initial consult.
