attacked by mentally retarded adult at work
Last year I was attacked by a mentally retarded adult at work. I work for an agency in a sheltered workshop. Long story short, after being trapped by desks and a wall; punched in the face, arm twisted, scratched, I had a torn rotator cuff injury. The company sent me for treatment (eg. physical therapy and all dr visits, etc.). I was discharged last year. This year I injured and re-tore the tendon at work. Drs say it may not have healed properly the first time. Now they want to do physical therapy again, etc. Do I stand a chance of obtaining a settlement over this. I am in pain, etc.

The answer, as you may have imagined, is it depends. If your physicians are willing to say that the problems that you currently have are related to the original work injury then that gives us a basis to argue that the medical treatment and any related disability should be compensated by the workers compensation carrier. If there is an ongoing obligation on there part then there may be an interest in settlement. Please contact my office to discuss this in more detail.
