Legal Question in Workers Comp in Pennsylvania

Bask injury needing advise

I need some advise or some guidance. A brief of my situation is I have been off of work for a little over two years now due to a fall (at work) resulting in nerve damage and disc herinatetion at L5/S1 I have been through to many to list of injections including a radio frequency. It appears to now be the disc and the Dr. stated that I am now a candiate for a disc replacement however he advised me that WC will not pay for a disc replacement. So where does this put me. I have been released to return to ligt duty with restrictions for some time now however my employer will not take me back with restrictions. I have been off and receiving benefits all this time however should I be looking to settle with WC since they will not correct the disc.I am unable to do my job? I am not sure what way this is heading.I have tried to talk this over with my attorney but he does not return my calls and I am in the process of looking for a new one.

WC tried to stop my benefits due to the return to work with restrictions however there petition was denied pending trial in March. The Judge at the hearing stressed about settling between both parties if at all possible. Not sure where this is going and need some legal guidance

Re: Bask injury needing advise

I can only suggest that you make an appointment with your attorney for a detailed review of your case, at which time you should ask your attorney all of the questions you have. Your attorney should have no problem with such an appontment. The issues you raise are too complex & too fact specific to provide you with an educated opinion. Good luck!!
