how to calculate settlement amount

Greetings,

I am close ot settling my WC case and I was wondering if there's a formula to figure out a fair and equitable settlement. They have already agreed to pay ongoing medical benefits. I was injured 1/14/04 and have been receiving WC checks since. I have been deemed 31% disabled and also was able to receive SSD. I collect

$345 weekly and they will cap at 500 weeks. I appreciate your response.

A standard settlement amount years ago was between 3 to 5 years of benefits. The present practice has changed and the insurance companies try to get a Compromise and release to cut off their responsibility for medical payments but since you are eligible for Medicare, I believe a portion of the settlement will have to be reserved for medical treatment related to the injury. I don't know that any of the insurers are using a set formula these days.
