Why am I on disability instead of Workers'Comp?

I have had 3 operations for CT syndrome all covered by WC. I reinjured myself and I am out again, but my employer which is an insurance co.

is sending me disability checks instead of WC. I need surgery soon, what gives? Should I get an attorney? Urgent!!

I can only guess that the company benefits manager or HR department is treating this reinjury as not work-related. Why they're doing that is impossible to tell.

If you believe the condition is still work-related, then your remedy is to file a claim petition. You won't get any more money, because the company will get credit for the disability payments against its comp obligation. But it will provide medical coverage for the treatment, if you can establish that the problem is related to the job.
