Legal Question in Workers Comp in Pennsylvania

fell at work

fFell on unprotected wet waxed floor at work.had partial repair that did not heal,now need total knee replacement. Will i be able to return to my original positon (if i am medically able)? They are at present covering it temporarily. Have been out 4 months, now at least 3 more post surgery.

Yes. Have any necessary corrective medical procedures done. Then fully recover. If you are medically able to RTW, then do so.

Watch out for a bait and switch to a new job with "modified" duties ostensibly protective of your medical restrictions. That job may evaporate and leave you without income. If that should transpire, you should have your WC re-instated.

If you are in a union, separate rules about leaving the bargaining unit and bidding may apply.

In short, you must get either workers' compensation or regular pay until you are completely recovered.

If not, well - that's why God created Workers' Comp. Lawyers.
