Legal Question in Workers Comp in Pennsylvania

Forced back to work

I was injured 5/07. Had knee surgery after injury. Work kept pushing for my return. Released for light duty with restrictions. Worked 2 weeks and reinjured knee due to employer not following restrictions. Had second surgery 9/07. Was returned to light duty a few weeks ago for light duty with severe restrictions. Again employer did not follow restrictions. Returned to physician who placed me back off for several weeks. Now WC said work has another light duty position available for me to work out of a wheelchair. I am a nurse and they now want me do do janitorial work. What rights do I have?

Re: Forced back to work

In general, you are obligated to work a light duty job that is within the restrictions provided by the treating doctor. These issues can get complicated. I strongly suggest you consult with an experienced worker's comp attorney in your area so that you don't make a crucial mistake in handling your claim. Most attys will provide you with a brief consult for no charge. Contact my office if you want a referral to such an atty. Good luck!!
