Legal Question in Workers Comp in Pennsylvania
Group Health Insurance while on w/c
I am an employer who has an employee out on w/c for 4 months now. She is on our group health insurance plan and I have been paying these since she is out. Do I need to keep her on my plan and if so, does she still need to pay the same percentage of the premium she was paying before?

Re: Group Health Insurance while on w/c
Most of the cases of which I'm aware are governed by union contracts or the provisions of employer benefit plans. But there may also be requirements of your workers' compensation insurer that health insurance be maintained while she's off on compensation so that the workers' compensation carrier doesn't get stuck with bills for care unrelated to the injury.
If there is no provision in the union contract, employee benefit plan, or compensation insurance policy, you may still want to check with the Pennsylvania Department of Labor and Industry.
