Legal Question in Workers Comp in Pennsylvania
ime report does not match
In oct I sustained a shoulder /neck injury at work. Sent to ortho..had mri shoulder(poss small rotator cuff tear). Went to a neurolgist for neck. EMG was so bad he gave me 14 nerve blocks to neck area. Range of motion of neck and shoulder reduced.
Went to IME...When i went in he stated ''you didnt hear any of this'' and proceeded to dictate all of the findings with me sitting there. Some reports were missing and i filled him in on who i saw and the treatment. He asked if i ever had an MRI of my neck. He filled out the paper for restrictions in front of me and stated he checked off can go back full time under the restricitons , but there is no such job, '' unless I could do something with a straw in my mouth''. The IME report has nothing or any of the reports with anything to do with my neck!! Nothing. I listened to him dictate it! He asked if I had an Mri of my neck, i said no. My IME report came back full range motion of neck!!! No mention at all of anything related to my neck. My shoulder is healing nicely but my neck is a mess...Now everything regarding my neck is denied! I heard him dictate ...it is not same report! All PT and any notes regarding neck were not stated in report!!!

This is typical behavior of a Comp carrier. If you do not have an attorney, you really need to get one. The only way that this will be fixed is thru the courts. I wish I could tell you something different. A Judge is going to have the hear testimony and deal with this. Let me know if you need a referral.

don't be alarmed. You are not alone. this bevahior is typical although disgusting. no one knows how bad SC can be until they themselves experience it. never, never vote for a republican in PA if you care about injured workers.
hire experienced Claimants' Counsel and buckle yourself in for a bumbpy ride. you should get to your destination ok if you can afford medical depositions of favorable doc(s).
Good Luck
