i was injured at work have tried several medicines and surgery to remove a piece of bo ne and scar tissue from my toe to date i still have pain in my foot what would be an appropriate amount to settle for

The amount of a settlement in a workers compensation case is largely dependent upon the amount of money that you earned prior to your injury. This figure is called the average weekly wage (AWW). Your benefit rate is 2/3 of that figure. A WC settlement is in essence an exchange of future rights for money. The injured worker gives up the right to receive benefits (wage loss and medical) in the future for a lum sum. Therefore, the greater the weekly benefit, the more value the case has. I am assuming that you are out of work completely at this point as that is a significant factor as well. If you have no wage loss than the value of the case is reduced because you are not giving up any significant rights.

The one thing that is not considered is "pain and suffering" you do not get compensation for pain and suffering in a workers compensation case. Since it is not a benefit that you are entitled to, it has no settlement value. i strongly encourage you to discuss thuis with an attorney.
