Legal Question in Workers Comp in Pennsylvania

injured worker to pay deposition fees

Please help, I was told I would have to pay nothing up front, only if my case won. Was injured in Oct 06. My attorney stated he had to start taking 20% out of my weekly comp check to pay for a dr deposition ..cost $4,000. I could barely make it on the weekly, let alone less than 20%. States though my case is very good. Do all deposition costs come out before hearing or settlement?

Re: injured worker to pay deposition fees

I'm a bit puzzled by this. If you are currently on compensation then the type of litigation that you're in is most likely a Termination or Modification Petition filed by your employer's insurance carrier. That means they are trying to cut off your benefits. The 20% deduction is for attorneys' fees and if your attorney is advancing $4,000.00 for a doctor's deposition then he must be convinced that you have a very good defense to the Termination or Modification Petition.
