Legal Question in Workers Comp in Pennsylvania

On The Job Injury

My shoulder was injured on the job and I was sent to the Doctor. The Dr. has has put me on light duty and issued several physical therapy sessions. My employer is marking me absent for these sessions and forcing me to set appointment times for the PT session after work, which due to children and time each day is not possible. Is there anything i can do about this?

Re: On The Job Injury

Unfortunately, you must seek medical attention on your own time unless the treatment can only be provided during your work hours. The fact that you have other non-work committments is of no consequence. However, if the light duty restrictions prevent your from working, then you would be entitled to wage loss benefits. But as long as your employer makes work available to you then you must perform that work and you must get your medical treatment during non-work hours. Please feel free to call me if you have any other questions.
