Legal Question in Workers Comp in Pennsylvania
How Long Can Workers Comp Payments Run?
I have been receiving workers comp for 3 yrs. I have had an atty since Jan 2007. He has been collecting 20% of each paycheck since then. He keeps telling me that he can't force the company to settle. But, how long do I have to go on paying him? It doesn't seem right that he continues to get paid for work that is not being done.

Re: How Long Can Workers Comp Payments Run?
He took the case on a contingency fee and the case was contested. In this type of case the fee is limited to 20% but it is 20% of the entire award. If he had not won, he would not get anything and right now most attorneys are very selective about taking workers' compensation cases because they generally have to advance a lot of money for costs and don't get that money back if they don't win.
Compare this to a personal injury case where standard fees are 33-40%, costs are deducted from the client's share of recovery, and where most of the cases are settled.
