How Long to workers comp want to settle Back Injury cases
Hi
I had a back injury from a set of steps that had broke with me on them and fell to a basement.My injurie was severe and had a blown disk in my back.I just finally had surgery in Jan of 2005,13 months later.I am sueing large corparation for my injurie.But I still have a lot of back pain.the leg pain seems to be gone now.I'm still waiting to hear if the spine has fused yet.Being a plumber and a HVAC tech I don't see any hope of being able to do my job anymore.I have things against me as weight,my age.Well to make this short I thought that workers comp only had 18 months to work with you or they would have to settle.I just don't know what to do.My Attorney is only a personal injurie Attorney.Any Advise.

It sounds as if you have a good case and the Carrier did not agree to pick up the claim so you have to litigate.
There is no 18 month rule in WC; someone may have told you that the average time for litigation is 18 months, but those figures are skewed by the many cases which settle short of requiring a full load of sworn testimony via depositions, extra fact-finding hearings, proposed findings of fact, etc.
keep your attorney informed. if he knows personal injury chances are good that he is experienced in WC and is doing a stellar job.
